The short version
We collect what we need to sell you clothing and run our shop well, we do not sell your information for money, and you can ask us to show you what we hold, correct it, or delete it. The rest of this page is the detail.
Who we are
BY DUSK LLC is a Delaware limited liability company based in Hingham, Massachusetts ("BY DUSK", "we", "us", or "our"). We sell apparel through bydusk.com and the online store that runs on it (together, our "Site"). Our Site is hosted on Shopify.
This Privacy Policy explains what personal information we collect, why, who we share it with, and what choices you have. It is part of our Terms and Conditions, available at bydusk.com/policies/terms-of-service, and is incorporated into them by reference. Where the two documents touch on personal information, this one governs.
1. Some words we use
Personal information means information that identifies you or could reasonably be linked to you. It does not include information that has been anonymized or stripped of identifiers so that it can no longer be linked to you.
Cookies are small pieces of data stored on your computer or phone when you visit a website.
Service providers are the companies that handle information on our behalf. Ours include Shopify, which hosts our store; Stripe, which processes payments through Shopify; Klaviyo, which we use for email and, in future, text marketing; hCaptcha, which helps us tell people from bots; Google Analytics 4, which tells us how the Site is used; and our shipping, fulfilment, and analytics partners. Advertising partners are the companies that help us show you our products elsewhere and measure whether that works. Ours are Meta, through the Meta Pixel, which supports our advertising on Facebook and Instagram.
Usage information is what we learn automatically from how you use the Site, such as which pages you looked at and for how long.
2. What we collect
Depending on how you use the Site and where you live, this can include:
- Your contact details, such as your name, email address, phone number, and billing and shipping addresses.
- Waitlist and early access signups. If you join our waitlist or sign up for news before a launch, we collect your name and email address so that we can send you the link when a collection opens.
- Payment and order information, such as your payment method, transaction details, confirmations, and billing records. Card numbers are handled by our payment processor. We do not store full card numbers.
- Account information, if you make an account, such as your username, password, and saved preferences.
- What you looked at and bought, including items viewed, added to a cart or wishlist, ordered, returned, exchanged, or cancelled.
- Messages between us, including emails, customer service enquiries, texts, reviews, and survey answers.
- Device and technical information, such as your IP address, device and browser type, operating system, and identifiers.
- Usage information, such as how you move around the Site, which pages you saw, and where you arrived from.
- Your marketing preferences, including whether you are subscribed to our emails or, where offered, our texts.
3. Where it comes from
- From you, when you order, make an account, sign up for emails, or get in touch.
- Automatically, from your device through cookies and similar technology, as described in Section 5.
- From our service providers, including Shopify, payment, shipping, analytics, and marketing partners.
- From other third parties, such as advertising platforms and social media services you use to interact with us.
4. What we do with it
- Selling you clothes and running the shop. Taking and fulfilling your order, processing payment, arranging delivery, handling returns and exchanges, managing your account, remembering your preferences, publishing reviews you send us, answering you, and making the Site better.
- Marketing. Sending you emails, and texts where you have given any consent the law requires, showing you our products on other platforms, and measuring whether any of it works.
- Keeping things safe. Verifying accounts, keeping payments secure, and spotting and dealing with fraud or misuse.
- Staying on the right side of the law. Meeting our legal, tax, and record-keeping obligations, responding to lawful requests, and enforcing our Terms.
5. Cookies and similar technology
We and our service providers use cookies, pixels, tags, and similar tools to keep the Site working, remember your cart and preferences, understand how the Site is used, and support advertising. They fall into three groups:
- Strictly necessary, which keep your session alive, hold your cart, and make checkout and security work. The Site cannot run without these.
- Performance and analytics, which show us how people use the Site so we can improve it. We use Google Analytics 4 for this.
- Advertising and targeting, which help us show you relevant ads and see how our campaigns perform. We use the Meta Pixel for this, which supports our advertising on Facebook and Instagram.
Your browser lets you block or delete cookies, though some things may stop working if you do, and Google and Meta each offer their own opt-out tools. We do not use a cookie banner on the Site. You can opt out of our sharing information for targeted advertising at any time using the methods in Section 8, including the Global Privacy Control signal, which we honor.
Bot protection. We use hCaptcha to tell real visitors from automated ones and to keep the Site secure. hCaptcha collects device and usage information for that purpose, and its own privacy policy is at hcaptcha.com/privacy. This is a security measure rather than an advertising one.
6. Who we share it with
We do not sell your personal information for money. We do share it in these situations, and some of that sharing counts as a "sale" or "share" for targeted advertising under some state privacy laws:
- Our service providers, including Shopify for hosting and store operations, Stripe for payment processing, Google Analytics 4 for analytics, Klaviyo for email and text marketing, hCaptcha for bot protection, and our shipping and fulfilment, order management, customer support, hosting, analytics, and IT providers.
- Advertising and marketing partners, who may use cookies to deliver and measure ads. This currently means Meta, through the Meta Pixel, which supports our advertising on Facebook and Instagram. Depending on where you live you can tell us to stop, as described in Section 8.
- Anyone you ask us to share with, such as when you have an order shipped to someone else or use a social login.
- Our affiliates, meaning companies under common ownership with us.
- Our professional advisers, such as lawyers, accountants, and insurers.
- A buyer or successor, if we are ever merged, acquired, financed, reorganized, or sold, in which case your information may transfer as part of the business.
- Authorities and others, where we need to comply with the law, respond to a subpoena or similar request, enforce our Terms, or protect the rights, property, or safety of BY DUSK, our customers, or anyone else.
7. Shopify
Our Site runs on Shopify, which collects and processes information about your visit in order to provide and improve the platform. What you submit through the Site is passed to Shopify and may be shared with third parties in other countries. We also use some of Shopify’s enhanced features, which draw on your interactions with our store, with other merchants, and with Shopify. For those, Shopify is responsible for its own handling of your information, including responding to requests you make about it. You can read more in the Shopify Consumer Privacy Policy at shopify.com/legal/privacy/app-users and the Shopify Privacy Portal at privacy.shopify.com/en.
8. Your choices and your rights
Depending on where you live, you may have some or all of these rights. They are not absolute and there are exceptions in the law.
- See what we have. Ask for access to, or information about, the personal information we hold about you.
- Have it deleted. Ask us to delete it.
- Have it corrected. Ask us to fix anything inaccurate.
- Take it with you. Get a copy in a portable format and, in some cases, ask us to send it to someone else.
- Opt out of targeted advertising. Tell us not to sell or share your information for targeted advertising. If you visit with the Global Privacy Control signal switched on, we treat it as an opt-out for that browser and device, and for your account where we can match it. We do not respond to other "Do Not Track" signals.
- Limit use of sensitive information, where the law gives you that right and we hold such information.
- Not be treated differently for exercising any of these rights. We will not discriminate against you.
Emails and texts. You can unsubscribe from marketing emails using the link in any of them, and from texts, if you have signed up, by replying STOP. We will still send you messages about your orders and your account.
How to ask. Email support@bydusk.com or write to us at the address in Section 13, or use any request form on the Site. We may need to confirm who you are first. You can ask someone to make a request for you, in which case we may need proof that they are authorised and may still need to verify you directly. We will reply within the time the law allows.
If we say no. Where your state gives you a right to appeal, you can appeal by contacting us at the details in Section 13 and saying that it is an appeal. You may also be able to complain to your state attorney general or data protection authority.
9. Children
Our Site is meant for adults. We do not knowingly collect personal information from anyone under 18. If you are a parent or guardian and you think your child has given us information, email us at the details in Section 13 and we will delete it. As of the date at the top of this page, we do not have actual knowledge that we sell or share the personal information of anyone under 18.
10. Keeping it safe, and how long we keep it
We use administrative, technical, and physical safeguards designed to protect your information from unauthorized access, use, alteration, and disclosure. No system is perfect, and nothing sent over the internet is completely secure while in transit, so please do not send us sensitive information through an unsecured channel.
We keep personal information for as long as we need it to run the shop, manage your account, do the things described in this policy, meet our legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. When we no longer need it, we delete it or strip out the identifiers.
11. Where your information goes
We are based in the United States and we process information here. If you use the Site from elsewhere, your information will be transferred to, stored in, and processed in the United States and other countries, whose data protection laws may differ from your own.
12. Marketing messages
We send marketing email only to people who have asked for it, we identify ourselves in every message, and every message has a way to unsubscribe that we act on promptly.
Text messages. We do not send marketing text messages today, and we plan to offer them in future. If we do, we will ask for your consent separately from your email signup rather than treating one as the other, we will tell you roughly how many messages to expect and that message and data rates may apply, and you will be able to stop them at any time by replying STOP or by contacting us. We will never make agreeing to texts a condition of buying anything.

14. Changes to this policy
We may update this policy as our practices change or as the law requires. When we do, we will post the new version here, update the date at the top, and give any further notice the law requires.
